Warren Real Estate Safety Protocols & Statewide Procedures

Warren Real Estate continues to provide you with COVID updates as we receive them.   As of Wednesday, May 19, 2021 the new guidance is in effect for real estate licensees pursuant to Governor Cuomo’s announcement that New York will now follow CDC guidelines.

Masks and Showings

  • If all parties are fully vaccinated, masks and social distancing are no longer required.
  • Businesses, sellers and landlords may still require masks regardless of vaccination status.

Mask Refusal

  • If the client/customer is unvaccinated or not fully vaccinated and refuses to wear a mask at a showing or open house the licensee is obligated under the Real Property Law to act in an honest and trustworthy manner and should not go forward with the showing/open house.

Vaccination Documentation

Sellers, landlords etc. can ask licensees and their clients/customers entering the property for the purpose of a showing or open house for proof of vaccination. If proof of vaccination is not provided the licensee and their clients/customers must wear a mask.

  • Proof of full vaccination status can be provided through paper form (vaccine card), digital application, or the State's Excelsior Pass.
  • Proof of full vaccination status can be provided by patrons through paper form, digital application, or New York State’s Excelsior Pass.
  • Proof of vaccination status can supersede the Health Safety Acknowledgment form currently used, but the licensee must document that they saw proof in their notes.
  • If the party refuses to provide proof of vaccination the individual is considered to be unvaccinated.
  • Children, not eligible for the vaccine must wear a mask.

Open Houses

  • It is best practice for visitors to wear a mask in situations where vaccination status may be difficult to ascertain.

Cleaning

When all parties are fully vaccinated licensees are not required to clean/disinfect the property after a showing. However, it is a good practice to continue to disinfect the property after a showing.
